When my step-dad passed away in 1983, he left some acerage to my nephew/brother (nephew by birth but was adopted and raised by my mother and step-dad, I was also adopted by my step-dad). Somehow my mother got the will probated so that my nephew/brother could not ever sell the acerage without her permission even though my dad's intent was that he could not sell it without her permission because first, as long as he was a minor and second, she would have the adjoining acerage and dad would want her to have the first option to purchase it.

As any of you who have any knowledge me and my family will know, my family is very dysfunctional and my mother has refused to allow my nephew/brother to sell this property even though she has long since sold her acerage (back in the 80's). She has refused because she believes she can force him to return to Texas to live by not allowing him to sell it and because she was leasing it and taking the money for herself.

This young man was 10 years old when dad died and dad also left him a percentage of an old well which my mother had control of as his guardian. She paid taxes on this property as well as income taxes, FICA, etc. for him out of this money. So in essence, he had been paying taxes on it for over 20 years while she was making the profit off of it. He finally got tired of it costing him when he couldn't do anything with it and stopped paying the taxes so it got taken by the county and sold for back taxes a couple of years ago.

There were excess proceeds from the sale of the property in excess of $5000.00 from that sale that he could claim but he would have to appear in court to claim them. Problem is that he went into the Marines right out of High School and at the time of the sale 2 years ago he was stationed in Okinawa. There was no way he could get home. He had 2 years to file a petition for this money.

He was just going to let it go and I finally talked him into checking into whether or not I could represent him in court or not. Turns out that I could. Earlier this year he filed his claim, sent me a POA and I went to court in his stead on Thursday, September the 28th.

My mother has managed to take everything else that my dad left for him and this property was worth far more that this amount but, PRAISE GOD, the judge has awarded this money to him. In addition this money has been in an interest bearing account since the sale and he will also be awarded 90% of the interest it has earned over the past 2 years, the remaining 10% is to go to the county.

This is another child that I was promised. My sister had given him up for adoption twice and taken him back and when I married and left for Japan I begged her to allow me to take him with me but she refused, promising me that if she decided to give him up she would let me have him. The next thing I knew my mother and step-day had him. So in my heart, again, he is mine, and always will be. This is the same sister who is the grandmother of the other child.

Thanks redbird for sharing this...I am glad that you were able to represent your nephew/brother and that he was able to claim his share of things etc...God bless
